Rights & Usage Terms
This page explains what a brand may do with content a creator delivers. Rights on OverTake are explicit: every job carries a scope, a duration and a territory, chosen at campaign setup and accepted by the creator before they start. Nothing is implied, and nothing is retroactive.
The three scopes
- Organic posting only. The creator posts to their own channel. You may not re-upload the asset yourself or put money behind it.
- Organic, brand-owned channels. You may also post the asset on your own accounts and use it in owned media such as your site, app store listing or email.
- Paid media usage. You may run the asset as advertising, including Spark Ads and paid social, within the agreed duration and territory.
Duration and territory
Duration is 3, 6 or 12 months, or perpetual where the creator offers it. Territory is the US, a named list of markets, or worldwide. Both are fixed at booking and shown on the asset in your workspace, so the answer to “can we still run this?” is on the asset itself rather than in someone’s inbox.
What you get, and what stays with the creator
You receive a licence for the agreed scope, duration and territory — not ownership. The creator keeps authorship of their work and their own right to keep the post up on their channel. That matters in practice: a licence that has expired does not remove a creator’s existing post, and the creator’s own platform account is always theirs.
What you may not do
- Use an asset outside its scope, past its expiry, or outside its territory.
- Sub-license, resell, or transfer the asset to another brand or entity, including a parent or subsidiary not named on the order.
- Re-cut an asset so it makes a claim the creator did not make, or edit it in a way that misrepresents them.
- Use a creator’s name, face or voice in anything they did not agree to, including any AI-generated version of them.
Extensions
A rights extension is a new paid order, linked to the original asset, priced with the creator. It can extend the duration, widen the territory, or move the scope up to paid media. Extensions must be agreed before the current term expires; an asset whose term has run out must come down until an extension is in place.
Music, footage and third-party material
Commercial music rights are not included by default. Platform-provided sounds are usually licensed for organic posting only and are frequently not cleared for paid media — which is the most common way brands accidentally breach a licence. If an asset is going into paid media, brief it with cleared or original audio from the start.
Assets you supply
You keep everything you supply — product footage, logos, scripts, brand assets. You grant us and the assigned creator a licence to use them for the campaign, and you confirm you have the right to grant it. That licence ends when the campaign does.
If rights are breached
Tell us and we will pause the asset and open a case. Use outside scope is a breach of the Terms, and it exposes you directly to the creator whose work it is. Where the breach is ours, we fix it and cover it.
